Terms and Conditions

The following terms and conditions outline the contract agreement between you and Odd Assembly Pty Ltd (ABN: 67 640 831 572) for the rental of our creative studio. These terms, in conjunction with any additional documents incorporated by reference, constitute the entire agreement between both parties. By booking with Odd Assembly, you agree to abide by these terms and conditions. Failure to accept these terms and conditions will result in the inability to secure a booking with Odd Assembly.

Definitions

In these Terms:

“Building” or “The Building” means the building where Odd Assembly is located, at Unit 3, 1-19 Regent Street, Redfern NSW 2016.
“Odd Assembly”, “We” “Our” or “Us” means Odd Assembly ABN 67 640 831 572.
“Equipment” means the equipment, furniture, or fittings residing in or as part of the studio.
“Gear” means the hire production gear, lighting, backdrops, and accessories residing in or as part of the studio.
“Estimate” means any estimated costs we send You for fees in relation to Your Hire request.
“Hire Period” or “Hire Date” means the date and time You occupy The Studio until the end of the period specified in the Hire Confirmation.
“Hire Confirmation” means the final confirmation Odd Assembly send You incorporating any agreed Estimate.
“Studio” or “The Studio” or “Concept Space” or “Creative Studio” means the Odd Assembly studio space at Unit 3, 1-19 Regent Street, Redfern NSW 2016.
“You” or “Your” means the person or entity entering into the agreement to hire the Studio from Us.

1. Grant of License to Hire Studio

a. In consideration of payment of the Hire Charges, Odd Assembly hereby grants You a non-exclusive license to use and occupy the Studio for the Hire Period.
b. The rights granted to You are non-exclusive and do not confer any right of tenancy or exclusive ownership of the Studio.

2. Availability

a. Odd Assembly is available for hire seven (7) days a week. Our regular business hours are from 8am to 10pm. If You wish to hire the Studio outside of these hours, please contact Us to make arrangements. We reserve the right to charge an additional fee for flexible hire times or additional hours outside of 8am to 10pm.
b. The Studio can be hired in the following ways:
i. A Full Day consists of 9 hours from 8am to 5pm and is charged at a rate of $480.00+GST per day.
ii. A Half Day consists of 4 hours either, 8am to 12pm, 1pm to 5pm, or 6pm to 10pm charged at $280.00+GST per half-day. The 6pm to 10pm incurs an additional $100+GST fee.**
iii. Additional hours can be negotiated and are subject to availability. Additional hours will be charged at Odd Assembly’s hourly rate of $80.00+GST per hour.

3. Bookings

a. An offer is only accepted when Odd Assembly supplies You with a corresponding Hire Confirmation via email which incorporates these Terms and Conditions.
b. Odd Assembly reserves the right to refuse any booking in its sole discretion. The Studio is subject to availability.
c. Odd Assembly may provide You with an Estimate based on Your requirements and a provisional hold will be placed on Your requested time/date to hire the Studio awaiting confirmation from You. Odd Assembly may cancel Your booking and release it to another customer if You do not confirm Your booking within a reasonable time.
d. Any request for studio painting (original studio white colour only) must be submitted in writing to Odd Assembly at least 72 hours prior to the start of Your hire charged at $200+GST.

4. Cancellations

a. If you need to cancel Your booking, You must promptly notify Odd Assembly. Upon cancellation, the following cancellation fees apply:
i. Less than 24 hours prior to the Hire Date: 100% of the Hiring Charges;
ii. Less than 48 hours prior to the Hire Date: 50% of the Hiring Charges;
iii. Less than 72 hours prior to the Hire Date: 25% of the Hiring Charges; and
iv. For all other cancellations: the balance of any Hiring Charges (minus a $20.00 cancellation fee) will be refunded in full.
b. If you need to cancel Your Event, You must promptly notify Odd Assembly. Upon cancellation, the following cancellation fees apply:
i. Less than 1 week prior to the Event Date: 100% of the Event Charges;
ii. Less than 2 weeks prior to the Event Date: 50% of the Event Charges;
iii. Less than 3 weeks prior to the Event Date: 25% of the Event Charges; and
iv. For all other cancellations: the balance of any Event Charges (minus a $200.00 cancellation fee) will be refunded in full.
c. Any approved refunds must be collected by the recipient within a period of three (3) months from the date of notification of the refund’s availability. Failure to collect the refund within this specified timeframe shall result in the forfeiture of the refund amount. Odd Assembly shall have no further obligation to process or honour the refund request after this three-month period has elapsed.”

5. Use of Studio

a. The Studio is to be left in the same condition as found, except for reasonable wear and tear. If Odd Assembly determines that the Studio is excessively dirty (as determined by us in our sole discretion), You will be charged a cleaning fee.
b. You are responsible for taking care not to damage or mark the Studio, including but not limited to walls, or floors.
c. You are responsible for insuring Your own equipment and personal property, including that of Your clients, associated personnel, and other third-party individuals. d. You are responsible for all loss or damage caused to the Studio by You or Your personnel or guests, except for reasonable wear and tear. Odd Assembly reserves the right to invoice You to recover Our costs of assessment, repair, and/or restoration in accordance with these Terms and Conditions.
e. Please ensure that Your public liability insurance covers You when hiring the Studio. You agree to indemnify Odd Assembly against any costs, including legal costs, damages, payments, fines, or interests that Odd Assembly may incur as a result of You breaching these Terms.
f. Odd Assembly ensures the Studio is cleaned and disinfected after every standard hire, as performed by Us.

6. Equipment and Gear

a. The equipment, furniture, and fittings residing in the studio are the property of Odd Assembly. If any of these items are damaged due to negligence during Your hire, You must promptly notify Us. We reserve the right to invoice You to recover the costs of assessment, repair, or replacement for damaged items in accordance with these Terms and Conditions.
b. We offer the option to hire gear such as production gear, lighting, backdrops, and accessories, subject to availability. The cost for hiring Gear will be determined by Us or set out in Odd Assembly’s Available for Hire list.
c. Gear is to be returned at the end of the Hire Period in the same condition as found, excluding reasonable wear and tear. If any gear is damaged due to negligence during Your hire, We reserve the right to charge You the costs of assessment, repair, or replacement.
